Section 1. This Ordinance shall be known and cited as the Recall Election Ordinance of the Town of Mount Desert and shall become effective immediately following adoption.
Section 2. Any elected official in the Town of Mount Desert shall be subject to a Recall Election where not less than twenty-five per cent (25%) of the registered voters of the Town, upon Petition to the Selectmen, call for such an election.
Section 3. The grounds for such Recall Election shall be as follows and the specific conduct complained of shall be alleged in the Petition for Recall Election:
a) Engaging in conduct which violates the Town Charter
b) Engaging in conduct which violates or ignores Federal or State law;
c) Engaging in conduct which brings the office into disrepute;
d) Engaging in conduct which by clear and convincing evidence displayus an unfitness to hold the office;
3) Engaging in any other conduct which reflects adversely on the best interests of the Town as set forth in its Comprehensive Plan.
Section 4. The Selectmen shall call a Special Town Meeting not more than forty-five (45) days after receipt of the Petition, at which the merits of the Petition may be debated and an open vote in favor or against Recall shall be taken. A majority of those present and voting shall be dispositive of the action to be taken.
Section 5. If a majority of those voting favor Recall, the official shall vacate the office and position as of the date the vote is recorded and a successor shall be chosen in accordance with the applicable provision of the Town Charter concerning the replacement of elected officials until the next annual Town meeting.
